Introduction

Oregon carriers pay for road use through the weight-mile tax, not through fuel tax. But sometimes Oregon fuel tax still gets paid at the pump. When that happens, the carrier is paying twice for the same miles.

Oregon law fixes this with a credit. You can deduct Oregon fuel tax you paid from the tax due on your Oregon Weight-Mile Tax Report. This guide explains who can claim it, how to take it on the report, what your invoices must show, and what to do if you missed it.

The Short Answer

Yes. Under OAR 740-055-0110(3), motor carriers purchasing fuel in Oregon "may claim a credit for Oregon state fuel tax paid at the pump."

You deduct the fuel tax paid from the tax due on your Oregon Weight-Mile Tax Report for the period in which the fuel was purchased, and you attach a copy of every fuel invoice you're claiming.

What Oregon Law Says

Two rules work together:

  • ORS 825.486 says Oregon fuel tax paid, whether collected directly by the seller or built into the price, is a credit against the amount of tax otherwise due under Oregon's weight-mile tax laws. The credit is allowed when the carrier submits its report along with satisfactory evidence of the fuel tax paid during the period reported.

  • OAR 740-055-0110 sets the details: how to deduct the credit, what invoices must show, how long to keep them, and how to ask for a refund later.

In short, the law treats Oregon fuel tax paid by a weight-mile carrier as a payment toward its road use tax, as long as it's documented correctly.

Which Fuel Tax Counts

The credit is for Oregon state fuel tax. That matters because a fuel receipt can show more than one tax. Under OAR 740-055-0110, the credit covers Oregon state fuel tax paid at the pump.

Keep in mind:

  • Fuel bought in Oregon is what the rule covers

  • The invoice must show the amount of fuel tax paid

  • Taxes paid to other states aren't part of this Oregon credit.

Before you claim, check each receipt to confirm Oregon state fuel tax was actually charged.

How to Claim the Credit on Your Report

  1. Collect Your Oregon Fuel Invoices. Gather every invoice for the reporting period.

  2. Match Each Invoice to a Truck. Each one should identify the vehicle that received the fuel.

  3. Add Up the Oregon Fuel Tax Paid. Use only the Oregon state fuel tax shown on the invoices.

  4. Deduct It on the Right Report. Take the credit on the Oregon Weight-Mile Tax Report for the period when the fuel was purchased.

  5. Attach Copies of the Invoices. Include a copy of all fuel invoices you're claiming.

The timing rule is important. Fuel bought in March goes on the March or first-quarter report, not a later one.

What Every Fuel Invoice Must Show

Under OAR 740-055-0110(2), each invoice must disclose:

  • Date and location of purchase,

  • Who it was purchased from,

  • Kind of fuel and number of gallons,

  • The base jurisdiction, license plate number of the vehicle enrolled in the weight-mile tax program, temporary pass number, or Special Transportation Permit number, if fuel goes directly into the vehicle,

  • Amount of fuel tax paid.

The rule also says:

  • Retail station purchases need an invoice or receipt from the original seller

  • Fuel card statements must clearly separate retail and cardlock purchases.

Bulk Fuel: The Extra Step

Carriers with their own fuel tanks need more paperwork. If you buy fuel in bulk, attach to the Oregon Weight-Mile Tax Report for the period when the fuel was dispensed into a truck:

  • Supplier invoices showing Oregon state fuel tax paid, and

  • Fueling records showing the fuel dispensed for each motor vehicle.

Notice the difference. For bulk fuel, the period that counts is when the fuel went into the truck, not when you filled the tank.

Missed the Credit? The Three-Year Refund Option

If you didn't take the deduction on the report for the right period, you still have an option. Under OAR 740-055-0110(4):

  • You may submit a written request for a refund of Oregon state fuel tax paid up to three years after purchase

  • It covers fuel tax not deducted on the report for the period of purchase

  • You must attach copies of all invoices

  • No refund is issued until an audit has been performed.

Because of the audit, a refund takes longer than taking the credit on time.

How Long to Keep Fuel Records

Under OAR 740-055-0110(1), all motor carriers must get an invoice for every purchase of motor vehicle fuel and keep it for three years, available for inspection by ODOT at all reasonable times.

That covers all fuel, not just the purchases you claim a credit for.

Common Mistakes to Avoid

  • Claiming in the wrong period. Use the period when the fuel was purchased.

  • Forgetting the invoices. Attach a copy of every invoice you claim.

  • Using a fuel card summary alone. Retail and cardlock purchases must be clearly separated.

  • Claiming other states' tax. The credit is for Oregon state fuel tax.

  • Tossing receipts. Keep every fuel invoice for three years.
